Terms for Companies

1. Acceptance of Terms

By accessing and using ProSieve's services as a company or on behalf of a company, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

ProSieve provides an AI-powered interview platform that allows companies to:

  • Create job postings
  • Generate interview links for candidates
  • Conduct automated AI interviews
  • Review and rank candidate performance

3. Pricing and Billing

Our pricing structure is as follows:

  • Your first job posting is free until you register a billing profile
  • Additional job postings require setting up a billing profile
  • You will be charged $3.00 per completed interview
  • Charges occur only when a candidate completes an interview
  • Payment processing is handled securely through Stripe
  • We may change the price of the service at any time, but we will notify you in advance

By providing your payment information, you authorize us to charge your payment method for all services you use. While payments are generally non-refundable, we understand that bugs may occur during this experimental phase. If you encounter any issues with our service or believe you were incorrectly charged due to a technical problem, please contact thomas@prosieve.com to discuss potential refunds.

4. Experimental Service Disclaimer

You acknowledge and agree that ProSieve is currently in an experimental phase. As such:

  • The service may contain bugs or technical issues that could affect its functionality
  • Features and pricing may change as we continue to develop and improve the platform
  • The AI interviewing system is under active development and may not always perform as expected
  • We strongly recommend testing the system thoroughly before using it for critical hiring decisions

If you encounter any bugs or technical issues, please report them immediately to thomas@prosieve.com. We are committed to addressing issues promptly and working with users to resolve any problems that arise during this experimental phase.

5. Account Registration

To use our services, you must register an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. User Conduct (Company)

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Post discriminatory or inappropriate job descriptions
  • Attempt to circumvent our billing system
  • Reverse engineer or attempt to extract our AI models or source code

7. Privacy and Data (Company Responsibilities)

We collect and process personal data as outlined in our Privacy Policy. By using our services, you consent to our data practices. You are responsible for obtaining appropriate consent from job candidates before directing them to our platform for interviews, including consent for audio and video recording as specified in the Candidate Terms and our Privacy Policy. You represent and warrant that you have all necessary rights and consents to provide any data (including candidate data) to ProSieve for processing.

8. Intellectual Property

ProSieve retains all right, title, and interest in and to the Services, including the website, platform, AI models, underlying technology, and any aggregated or anonymized data derived from the use of the Services ("ProSieve IP"). This Agreement does not grant you any rights to ProSieve IP except for the limited right to access and use the Services as permitted herein.

You retain ownership of the job descriptions and other content you provide ("Company Content"). You grant ProSieve a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Company Content solely for the purpose of providing and improving the Services.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, for any reason, without notice. Upon termination, any outstanding charges will be billed to your payment method.

10. Disclaimer of Warranties

IN ADDITION TO THE EXPERIMENTAL SERVICE DISCLAIMER (SECTION 4), THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PROSIEVE DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability (Company)

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. We do not guarantee that our AI screening system will be error-free or that it will provide perfect candidate evaluations. Given the experimental nature of our service, you acknowledge and accept that there may be bugs, interruptions, or unexpected behavior.

12. Indemnification (Company)

You agree to defend, indemnify, and hold harmless ProSieve, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Services; (b) your Company Content; (c) your violation of these Terms; (d) your violation of any third-party right, including any intellectual property right or privacy right; or (e) any dispute between you and any candidate or third party.

13. Changes to Terms

We may modify these terms at any time by posting revised terms on our website. Your continued use of our services constitutes acceptance of the modified terms.

Terms for Candidates

1. Acceptance of Terms

By participating in an interview or submitting an application through the ProSieve platform as a candidate, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

2. Interview Process and Consent to Recording

The interview process on the ProSieve platform involves interacting with an AI interviewer. By proceeding with the interview, you explicitly consent to the following:

  • The interview session will be recorded, including both audio and video
  • Your responses, audio, and video data will be processed by our AI systems
  • This recorded data will be stored and made available to the company to which you applied for evaluation purposes

If you do not consent to audio and video recording, you should not proceed with the interview.

3. Candidate Applications

By submitting your application and participating in an interview through our platform, you acknowledge and agree to the following:

  • Your application, resume, interview recordings (audio and video), and AI analysis will be stored in our database and shared with the specific company you applied to
  • You may not receive a response to your application or interview due to high volume, company decisions, or lack of matching opportunities
  • Absence of response does not imply any judgment on your qualifications or experience
  • Your application data may be retained as per our Privacy Policy and the hiring company's policies. You may request deletion as outlined in the Privacy Policy.

We provide the platform for interviews, but hiring decisions are solely at the discretion of the company you applied to. We cannot guarantee that every application or interview will receive a response or result in a job offer.

4. Privacy and Data (Candidate)

We collect and process your personal data, including application information and interview recordings (audio and video), as outlined in our Privacy Policy. By using our platform (e.g., submitting an application, participating in an interview), you consent to these data practices. Please review the Privacy Policy for details on data handling, storage, sharing with the hiring company, and your rights (including data deletion requests).

5. Intellectual Property (Candidate Data)

You retain ownership of the personal information and responses you provide during the application and interview process ("Candidate Data"). By using the platform, you grant ProSieve and the specific company you applied to a license to use, store, process, and analyze your Candidate Data (including recordings) for recruitment and evaluation purposes, as described in these Terms and the Privacy Policy. ProSieve owns the platform, AI technology, and any analysis derived from Candidate Data.

6. Disclaimer of Warranties

THE PLATFORM AND INTERVIEW PROCESS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, PROSIEVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOME FROM USING THE PLATFORM, SUCH AS AN INTERVIEW OR JOB OFFER. THE AI INTERVIEW SYSTEM IS EXPERIMENTAL AND MAY NOT PERFORM FLAWLESSLY.

7. Limitation of Liability (Candidate)

To the maximum extent permitted by law, ProSieve shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the platform. The AI interview system is experimental and may contain bugs or produce unexpected results. ProSieve is not responsible for hiring decisions made by companies using the platform.

8. Indemnification (Candidate)

You agree to defend, indemnify, and hold harmless ProSieve and the hiring company from any claims or liabilities arising from (a) your use of the platform; (b) any false or misleading information you provide; (c) your violation of these Terms; or (d) your violation of any third-party rights.

9. Changes to Terms

We may modify these candidate terms at any time. Any changes will be posted on this page. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

General Terms

1. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Wilmington, Delaware before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. YOU AND PROSIEVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

2. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

3. Entire Agreement

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and ProSieve regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

4. Waiver

No waiver by ProSieve of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of ProSieve to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

5. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent.
